These terms govern the use of the AURUM PULSE, AURUM SHIFT and AURUM RADAR indicators (together, the "Indicators") and of the two chart templates you receive with the licence. The licence is granted by [DATI DI FABRIZIO: name or company name, address, VAT number] (the "Licensor"), contact: [CONTATTO DEL TITOLARE]. By asking for the licence and ticking the acceptance box you declare that you have read and accepted these terms and the risk warning.

1. What you receive

A free, personal, non-exclusive and non-transferable licence to use the Indicators, in compiled form (.ex5), for MetaTrader 5 and the XAUUSD instrument. The software remains the property of the Licensor: you receive the right to use it, not the software itself.

2. One account, for life

• The licence is valid for one MetaTrader 5 account number only, the one given in the form. You may use the Indicators on more than one computer or VPS, as long as they are connected to that account.
• It has no expiry date. It stays valid as long as you comply with these terms.
• Each email address has one licence only, and each account number can be registered once.
• On a different account the Indicators do not work. The licence cannot be transferred to another account: the account number is written into the signed licence. Before you register, choose the account you will use the Indicators on.
• You may give up the licence at any time: uninstall the Indicators and, if you wish, erase your data from the My data page of the website.

3. What you may and may not do

You may install and use the Indicators for your own trading, on the licensed account.

You may not:

• assign, lend, sell, rent or share the Indicators, your chart templates or your licence key;
• publish or distribute the Indicators or the key, even free of charge, even in private groups;
• decompile, disassemble, modify or bypass the licence check, except where the law expressly allows it;
• use the FDB AURUM, AURUM PULSE, AURUM SHIFT and AURUM RADAR marks or the name Fabrizio di Benedetto for your own products or services;
• resell the Indicators' signals as a service to third parties without a written agreement with the Licensor.

4. True details

You must give true details and an account you hold or are entitled to use. You must be at least 18 years old.

5. Updates

The Licensor may publish new versions, but is not obliged to do so, nor to keep the Indicators compatible with future versions of MetaTrader 5 or with your broker's conditions. New versions may need a new licence key: if your data is still registered, you will receive it free of charge on the same terms.

6. No warranty

The Indicators are provided free of charge "as is", without warranties of any kind, express or implied: in particular, there is no warranty that they are free of errors, that they run without interruption, or that they are fit for a particular purpose. No trading result is promised. This does not affect consumer rights that the law does not allow to be excluded.

The Indicators do not open or close orders. Every trading decision is yours.

7. Not financial advice

The Indicators are technical analysis tools. They are not investment advice, personal recommendations, or a management or signal service. They do not take into account your financial situation, your goals or your tolerance for risk. Before trading, consider asking an authorised adviser if you need one.

8. Limitation of liability

To the fullest extent permitted by law, the Licensor is not liable for trading losses, loss of profit, loss of data, outages of MetaTrader, of the broker, of the connection or of the computer, or for indirect damage arising from the use of, or the inability to use, the Indicators.

This limitation does not apply to damage caused by wilful misconduct or gross negligence (Article 1229 of the Italian Civil Code), nor to consumer rights that the law does not allow to be excluded.

9. Breach of the terms

If you breach these terms, in particular by sharing the key or the templates, the Licensor may refuse you new keys, new links and updates, and may enforce its rights.

10. Privacy

The data you provide is processed as described in the privacy notice. From the My data page of the website you can see it, download it, change the optional consents and erase it.

11. Changes to the terms

The Licensor may change these terms. The version in force is always published on this page with its date. Changes apply to licences issued and updates downloaded after publication.

12. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, disputes fall under the court of the place where you reside or are domiciled, and the mandatory protections of the law of your country of residence still apply. In all other cases the courts of [CITTÀ DA COMPILARE] have exclusive jurisdiction.
